Background
Queensland University of Technology (QUT) and the Participating Organisations are conducting a research project titled Australian Acoustic Observatory: A Network to Monitor Biodiversity which involves, amongst other things, the collection and procession of Data from a network of reference sites around Australia. The project has received funding from the Australian Research Council (ARC). Your submission and/or usage of the Data is governed in accordance with these terms. By submitting, accessing and/or using the Data in any way, you agree that you (or the organisation/entity in which you are acting on behalf of) will comply with these terms.
Submitting Data
You acknowledge and agree that all rights, title and interest in the Data (including any intellectual property rights subsisting in the Data) submitted by you will vest in QUT.
Accessing and/or Using Data
You acknowledge that use of the Data by any third party is governed in accordance with the Creative Commons license, Attribution 4.0 International Licence.
Disclaimers and Warranties
You agree that access and usage of the Data in any medium or format (including any modified format) is entirely at your own risk and you accept that neither QUT, the Participating Organisations or the ARC will be liable (whether in tort (including negligence) contract, statute or otherwise) for any direct or indirect loss or liability arising from your access or use of the Data (in any format), including consequential loss, loss of profits, loss of opportunity, loss of income or loss of data.
To the full extent permitted by law, QUT makes no warranty nor any representation in respect of the Data, including any warranty or representation that the Data:
- is accurate or of a certain quality;
- is fit for any, or a particular, purpose;
- does not infringe the rights of any other person.
Terminating the Licence
Your right to use the Data continues for as long as you follow these and the CC BY 4 license terms. If you breach the terms, your licence is revoked and you must immediately cease using the Data (in any format).

Attribution
You must give appropriate credit, provide a link to the license, and indicate if changes were made to the Data. You may do so in any reasonable manner, but not in any way that suggests QUT, the Participating Organisations or the ARC endorses you or your use.
No additional restrictions
You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.
Adapt
You may remix, transform, and build upon the Data for any purpose, even commercially. You may reproduce and share your adapted material.
Share
You may copy and redistribute the Data in any medium or format and in whole or in part. If you share adapted material you produce, the Adapter’s License you apply must not prevent recipients of the adapted material from complying with the CC By 4 licence.
When you share or publish any material that includes the Data, you must include:
- the Attribution Notice,
- the Disclaimer and Warranty clause (mentioned above);
- indicate if you modified the Data and retain an indication of any previous modifications;
- include a URI or hyperlink to the Data to the extent reasonably practicable; and
- indicate the Data is licensed under the CC BY 4 Licence, and include the text of, or the URI or hyperlink to the CC BY 4 Licence

Definitions
Data means any information or record that is captured or generated by a research station for the purpose of the project, including without limitation acoustic, image, and other records and files.
